RE: \\ Three Suspects Arrested for Brazen Armed Robbery inside Resturant

How long will Jermaine fendley be in jail for ?

Each of the three suspects were charged with the same three charges, however Fendley is the only one old enough to be charged as an adult.

The answer is highly conditional and requires a bit of information we don't have yet to be more exact, but given a reading of the laws for each charge you can arrive at a range. This of course if he isn't offered a plea deal before trial and is found guilty.

  • Armed Robbery - (16-8-41) - At least 10 years, but no more than 20 years
  • Robbery - (16-8-40) - At least 1 year, but no more than 20 years.
  • Possession Of Pistol Or Revolver By Person Under 18 YOA1 - (16-11-132) - 3 years / 5,000$

This is to say that if he were to go to trial and be found guilty on all three charges, he's looking at anywhere between 14 and 43 years.

It should be noted that due to Armed Robbery being a " forceable felony " under OCGA § 17-10-6.1 (2025), the following would apply ...shall be sentenced to a mandatory minimum term of imprisonment of ten years, and no portion of the mandatory minimum sentence imposed shall be suspended, stayed, probated, deferred, or withheld by the sentencing court.

Footnotes

  1. This assumes a 2nd offense. While his criminal history is unknown due to his age, this charge is a felony on the charge document and according to the law, the only way this becomes a felony as opposed to a misdemeanor is on a " second or subsequent violation ". If it was a misdemeanor it would be 1 year / 1,000$
