Driver Charged in November 2024 Fatal Accident
Corey Macarius Williams charged with Homicide by Vehicle 2nd Degree

November 2024 Accident 

Just after 1 PM on the afternoon of November 8th, 2024, units were dispatched to a severe accident at the intersection of Highway 74 and Rising Star Rd just north of Haralson.

According to the GSP crash report of the incident, a gray BMW driven by Delcine Erving of Fayetteville, was traveling south on Highway 74 attempting to make a left turn onto Rising Star Rd when a GMC Savana cargo van, driven by Corey Macarius Williams and also traveling south on Highway 74, failed to stop and struck the back of Erving’s BMW.

The force of Williams’ cargo van striking the BMW caused the front of the BMW to rotate into the oncoming lane where it was than struck in it’s passenger side by a third vehicle, a F-350 dually driven by a Senoia resident. After striking the BMW, the F-350 left the roadway and struck several trees.

Williams’ cargo van continued off the roadway after hitting Erving’s BMW and struck a sign belonging to the First Baptist Church of Haralson before coming to a stop.

The driver of the F-350, as well as Erving and a female passenger in the BMW were all transported to Grady Memorial Hospital with serious injuries while Williams was transported to Piedmont Newnan Hospital for non-serious injuries. 

According to the report, Williams told the GSP Trooper investigating the accident that Erving had ” suddenly stopped ( in front of him ) and he did not have enough time to stop.” This was contradicted however by a witness who had been driving the vehicle directly behind Williams at the time of the crash who stated they’d seen the BMW stopped with it’s left turn single on and that Williams had just failed to stop.

The report shows that Williams was cited for Following too closely at the time of the accident.

On December 11th, 2024, GSP investigators were notified by the Coweta County Coroner that the driver of the BMW, Delcine Erving, had passed away due to the injuries sustained in the crash.

Williams Charged, Faces up to 1 year in jail, $1000 fine

On October 12th, 2025, Corey Macarius Williams, 30, of Marietta, was booked into the Coweta County Jail on a single misdemeanor charge of Homicide by Vehicle in the 2nd degree. Booking records indicate that Williams was released a few hours later after posting a $2500 bond.

According to O.C.G.A. § 40-6-393(c):

Any person who causes the death of another person, without an intention to do so, by violating any provision of this title other than subsection (a) of Code Section 40-6-163, subsection (b) of Code Section 40-6-270, Code Sections 40-6-390 through 40-6-391, or subsection (a) of Code Section 40-6-395 commits the offense of homicide by vehicle in the second degree when such violation is the cause of said death and, upon conviction thereof, shall be punished as provided in Code Section 17-10-3.

According to O.C.G.A § 17-10-3, which sets forth punishment ( in general ) for misdemeanors in the state:

(a) Except as otherwise provided by law, every crime declared to be a misdemeanor shall be punished as follows:

(1) By a fine not to exceed $1,000.00 or by confinement in the county or other jail, county correctional institution, or such other places as counties may provide for maintenance of county inmates, for a total term not to exceed 12 months, or both;

(2) By confinement under the jurisdiction of the Board of Corrections in a state probation detention center pursuant to Code Section 42-8-35.4 for a determinate term of months which shall not exceed a total term of 12 months; or

(3) If the crime was committed by an inmate within the confines of a state correctional institution, by confinement under the jurisdiction of the Board of Corrections in a state correctional institution or such other institution as the Department of Corrections may direct for a term which shall not exceed 12 months.

Delcine Stiney Erving, 69, of Fayetteville, GA formerly of Hardeeville, SC entered through heaven’s gates on Tuesday, December 10, 2024 at Harbor Grace Hospice in Atlanta, Georgia with her loving family at her side.
